Litigation & Recoveries

Lester Aldridge is acting in one of the most closely watched Court of Appeal cases of 2026, Angel and others v Black Horse, which was heard on 22 and 23 April.

The appeal concerns the legality of bringing large volumes of consumer motor finance claims on a single claim form under CPR 7.3, often referred to as “omnibus claims”. The proceedings involve eight lenders and focus on claims alleging unfair relationships under the Consumer Credit Act, arising from the non‑disclosure of commission in motor finance agreements.

While lenders largely succeeded in last year’s Supreme Court decision on commission disclosure, the procedural question surrounding omnibus claims was left unresolved. That uncertainty has since prompted significant volumes of litigation within the motor finance sector and has arisen alongside the Financial Conduct Authority’s plans for an industry‑wide redress scheme.

Ann Lloyd, Partner and Head of our Litigation & Recoveries team, is the instructing solicitor for two major motor finance providers in the appeal. Her involvement highlights the firm’s position at the forefront of complex, large‑scale financial services litigation with market‑wide and regulatory significance.

The appeal has attracted national attention and has been identified by The Lawyer as one of the Top 10 Appeals of 2026, alongside extensive coverage in broadcast and financial media.

The Court of Appeal’s judgment is awaited and is expected to be highly influential, with the potential to shape both future motor finance litigation strategy and wider procedural practice for mass consumer claims.
