Funding 3C

Securing funding is an essential part of every charity’s day to day life. And as grant funding becomes more difficult to obtain, you’re probably looking at other ways to raise funds to fulfil your mission. But different ways of funding mean different legal questions. Getting the right legal advice is essential if you are going to make a success of any new way of funding.

Our charity law team can advise you on all aspects of charity funding:

  • Charging for services and ancillary activities
  • Trading subsidiaries – when should a charity set up a trading subsidiary, how should it be financed and the relationship between the charity and its subsidiary
  • Borrowing – we advise on bank finance, the lending covenants and associated mortgages
  • Public collections, lotteries and other fund raising schemes
  • The negotiation and drafting of contracts for the provision of services and the terms and conditions attached to grants

We have plenty of experience in advising charities like yours on all aspects of funding. Our work has included:

  • Advice to a charity about the extent of its investment in its subsidiary
  • The drafting of a contract with a university for the provision of research
  • Advice upon a fundraising competition to win a “Gold Disc”
  • The negotiation on behalf of a hospice of specialist NHS grant funding secured against hospice property
  • A contract for the loan of a tank from a museum collection to a film company
