Our employment and healthcare solicitors are receiving a large number of queries and concerns over the mandatory vaccination requirements for care homes being introduced by the Health and Social Care Act 2008 (Regulated Activities) (Amendment) (Coronavirus) Regulations 2021 (‘the Regulations’). There is understandably a great deal of uncertainty about the measures that providers will need to put in place to comply with the Regulations, and there is not long to do so before the 11 November 2021 deadline.

To assist providers in preparing for the Regulations, we have prepared two toolkits of template letters and guidance, which will be available for a fixed fee:

  • A recruitment pack to ensure compliance with the regulations when taking on new staff. This will include a template offer letter and contract wording for both pre-November 11 and post-November 11 contracts. The cost will be £300 plus VAT.
  • A staff management pack providing the key documents and guidance so that providers can be confident that they will be in a position to comply with the regulations by 11 November in relation to their existing staff. The pack will enable providers to communicate the changes being made by the regulations and consult with unvaccinated staff so that they will have satisfied the requirements necessary to dismiss unvaccinated staff fairly if necessary. This will include the template correspondence with staff for each of the various steps of the process, including dismissal, and guidance to use in the consultation meeting. The cost of this will be £750 plus VAT.
  • There will also be the option to add three hours of advice throughout the process from a solicitor at a fixed cost of £500 plus VAT.
