Navigating the new regulatory landscape for 16 & 17-year-olds

Operating a children’s home requires unwavering commitment to the highest quality of care, coupled with navigating the rigorous requirements of Ofsted and other regulatory frameworks and legislation such as the Care Standards Act 2000.

We are an experienced team of Ofsted lawyers who provide specialist legal support to help children’s homes achieve and maintain compliance, manage inspections, and navigate complex enforcement action.

How We Help Children's Homes Providers

We offer a complete service for children’s home providers, including their staff, such as Registered Managers and Responsible Individuals, assisting with challenges at every stage of your journey.

  • Registration and Governance: Navigating the registration process is complex, from completing the SC1 application to meeting the ‘fitness’ requirements for Registered Managers and Responsible Individuals. We can provide you with advice about initial registration, variations, and assist in responding to Notices of Proposal to refuse registration.
  • Proactive Compliance: We provide advice in relation to Ofsted inspections including advising around Statements of Purpose, policies (e.g., safeguarding, behaviour management), and quality assurance procedures to ensure you are properly advised on the requirements the Children’s Homes Regulations 2015 and the Social Care Common Inspection Framework (SCCIF).
  • Challenging Inspections and Reports: If an inspection leads to a challenging or unfair outcome, we have significant advice on drafting complaints and factual accuracy submissions to Ofsted.  We also support providers through the calls with Ofsted with Ofsted complaints investigators.
  • Responding to Enforcement Action: We provide comprehensive advice and support about Ofsted enforcement actions, including requirement notices, and Notices of Proposals and/ or Decisions to suspend or cancel registration and to impose conditions.
  • Safeguarding and Investigations: When a safeguarding issue or other incident arises, we provide urgent advice and representation during investigations, LADO meetings, interviews under caution (in some circumstances), and Coroner’s inquests.

Why Specialist Advice is Vital

The regulatory landscape for children’s homes is distinct and demanding.

Our in-depth knowledge of the Children’s Homes Regulations 2015, the Quality Standards, and the Social Care Common Inspection Framework (SCCIF) is crucial for an effective legal strategy. We are also an experienced team of lawyers across adult social care, acting for some of the largest providers in the country.  Our understanding of both sectors (adults and children) equips us to be one of the leading firms in children’s and adult’s social care.

We understand the commercial and reputational stakes involved and provide pragmatic, clear advice to protect your children’s home, wider commercial reputation and, most importantly, the children in your care.
