Pauline advises providers of adult residential care and nursing homes, independent hospitals and clinics, digital healthcare, supported living facilities, domiciliary care agencies, children homes and schools on a range of issues.
Her work includes advising providers in disputes with regulatory bodies, including dealing with enforcement action by CQC and representing providers throughout the appeals process in the First Tier Tribunal and in relation to professional misconduct hearings. Pauline also advises providers in relation to issues with Ofsted and appeals to the Independent Complaints Adjudication Service for Ofsted. She also has experience of dealing with inquests, safeguarding and police investigations, local authority or CCG contractual disputes, disputes with residents, applications to the Court of Protection and judicial review proceedings within the care sector.
In addition, Pauline undertakes regulatory due diligence for sales, acquisitions or refinancing of all types of care facilities, including care homes, independent hospitals, day schools, children’s homes, independent special schools, fostering agencies, acute medical units and fertility clinics.
Recent examples of work or case studies:
- Acted for providers in defending applications to add beds and new locations to existing CQC registrations for services for people with learning disabilities and/or autism.
- Acted for a large digital healthcare provider on a range of regulatory issues.
- Advised a European online retailer of designer eyewear on the regulatory requirements for Opticians and Ophthalmologists, enabling the opening of their first store in the UK.
- Carried out regulatory due diligence in respect of the refinancing of a large provider of independent hospitals.
