Sabah is an experienced planning and environment solicitor advising on all aspects of planning and environmental law. Sabah advises on contentious and non-contentious matters including, advising and negotiating on complex s106 agreements, nitrates mitigates agreements, highway agreements, Biodiversity Net Gain. Community Infrastructure Levy, advising and negotiating on judicial review and planning statutory appeals, listed building, and planning enforcement. Sabah is an experienced planning solicitor, having worked for both local planning authorities and private practice.
Sabah has over a decade experience of working for local planning authorities in southeast and has spent the last 5 years working as planning and environmental solicitor for private practice advising on all aspects of planning and environmental law.
Recent work
- S287 statutory review of planning inspector’s appeal decision. The Secretary of State conceded that the planning inspector had failed to provide legally adequate reasons for his conclusion that the site was in mixed B2 and B8 use. The matter was remitted back for rehearing and redetermination and some of client’s costs were paid.
- S288 statutory review of planning inspector’s decision where Secretary of State conceded that the Planning Inspector failed to have regard to material consideration whether the extent of building works required to convert the redundant barn to dwelling house was a “conversion”.
- Advised and assisted counsel in relation to whether land formed part of curtilage listed of landmark building Harrods Depositary in Richmond.
- Advised and assisted developer on appealing CIL liability over a million pounds under Reg 113 and Reg 114.
