Tom is a commercial litigator specialising in commercial disputes. Tom acts for clients in a variety of different types of disputes, but typically, those claims involve breach of contract, company disputes (director and shareholder conflicts and post-merger issues), commodity claims (including disputes over artwork), contentious probate, insolvency, and cross-border issues.

Tom represents and advises a wide range of clients including businesses and individuals, acting for both claimants and defendants. A characteristic of the service Tom provides is a pragmatic and commercial approach to disputes, seeking to find cost–effective solutions which accord with the client’s objectives. As such, alternatives to court proceedings are always at the forefront of his mind, with a particular focus on adjudication, arbitration and mediation, seeking to ensure a confidential, agreeable and proportionate outcome. However, in circumstances where disputes cannot be readily solved, Tom is able to draw on his experience to conduct proceedings in the Courts and Tribunals.

Tom has been involved in contentious legal work for almost 20 years, having worked in disputed costs and litigation departments prior to qualifying as a solicitor. Since qualification, Tom has worked as a commercial litigation solicitor for firms in London and the southeast, acting in a variety of complicated, contentious and noteworthy claims in the Courts and Tribunals of England and overseas, in collaboration with international colleagues.

Recent work

  • Director, shareholder and employment dispute concerning the resignation of managing director for a large company. The issues concerned the consideration of shareholder agreement/articles in the context of claims for unfair prejudice and minority shareholder claims.
  • Director and shareholder misfeasance claims in respect of steps taken by majority shareholder and family office.
  • Claim following the failure of a joint venture concerning a proposed significant entertainment venue in Central London. After local opposition and a failure to obtain the relevant licenses for the venue, the vessel left the UK and there were claims made in respect of expenses and damages under the terms of variously amended Joint Venture agreements.
  • Acting to resist enforcement proceedings in the UK and the Caribbean of a multi-million Swiss judgment to which Worldwide and local freezing and asset disclosure orders were made.
  • Acting for sellers of businesses in numerous claims for deferred consideration and earn out payments.
  • Acting for sellers of high-profile art in claims where the return on and speed of investment were challenged by or said to have been misrepresented. Separately, acting in claim where the authenticity and provenance of paintings and ancient artworks have been questioned and allegations of fraud and misrepresentation have been made.
