Divorce or relationship breakdown is a difficult time for all involved. It’s natural if you are considering a divorce to worry about the future; sorting out your money, your family home and protecting your children.
We understand exactly what is involved when undertaking divorce proceedings and we want to help you decide what is right for you. Our divorce lawyers can provide you with legal advice on:
Divorce, separation and civil partnership dissolution
No two families’ experiences are ever the same and we provide straightforward advice and guidance tailored to you throughout the process of divorce, dissolution or judicial separation.
Financial claims on divorce or dissolution
Following the breakdown of your marriage or civil partnership and the start of your divorce or dissolution, either you or your partner can apply to the court for financial provision (also known as a financial remedy), which we can help with.
Children
The Children Act 1989 lists various matters which the court must always take into account (‘the welfare checklist’). Your child’s welfare is the court’s paramount consideration.
Property
Various different orders can be made by the court to determine how property will be dealt with. The order made regarding your property will depend entirely on your particular circumstances.
International family law
As members of Resolution (an association for family lawyers) and MSI (an international network of lawyers), we are in a great position to help you with UK or international family matters. Our MSI membership enables us to access specialist legal advice in a variety of countries around the world.
How does divorce work?
You are able to issue divorce proceedings if you have been married for over a year, provided one or other of you has lived in England or Wales during the whole of the preceding year or is domiciled here.
In order to be granted a divorce, you have to demonstrate that the marriage has irretrievably broken down.
Initial meeting
For your initial meeting with your family law solicitor, you will need to bring identification as we are required by law to check who you are. You will also need to bring your original marriage or civil partnership certificate.
Your first meeting with your divorce solicitor will usually last between 1 – 2 hours, depending on your circumstances; and we will not place a limit on how much time we spend with you.
