Lester Aldridge has successfully concluded a clinical negligence claim and secured a five-figure settlement for a client following the defendant’s failure to treat an injury to his left arm properly.

The client injured his upper left arm when lifting a heavy bag. He attended the A&E department at his local hospital and was found to have damaged the bicep muscle. He was referred to the fracture clinic and advised that his injury would be treated conservatively without an operation. The client was then seen by another orthopaedic surgeon, who advised him that surgery would be the best course of treatment. The client underwent surgery to correct the injury to his bicep. 

Following the surgery, the client developed neurological symptoms affecting his ulnar nerve.   

A claim was pursued against the defendant, the NHS trust, where the client was treated, on the basis that a negligent surgery was performed and that the surgery had no realistic prospects of success. This negligence caused the client to sustain permanent damage to his ulnar nerve, which has affected his everyday life.

The defendant maintained a denial of liability throughout the claim, but with the assistance of an orthopaedic expert and a peripheral nerve expert on the client’s condition, we secured a five-figure settlement.

On the settlement of the claim, the client said, “Thank you for all your hard work on my claim and for securing such a good settlement that will allow me to move forward with my life.”
