What is the process for making a personal injury claim?
Here’s a quick guide to what to expect when making a personal injury claim.
One of our specialist personal injury lawyers will come to see you at home or in the hospital, or we can conduct a virtual meeting if you prefer. We will discuss with you exactly what we can do for you and your family and how we can help you with your rehabilitation in the early days following the incident. This initial meeting is without any obligation at all. We won’t pressure you, and we certainly won’t push you into anything that you are not comfortable with. When you are ready to proceed, we will enter into a no-win, no-fee agreement, and we can then start to work really hard for you to secure the care and rehabilitation that you need and deserve.
We will start to gather the expert evidence that we need for the claim. We will involve experts in rehabilitation and medical professionals who can help us get together the information that we need to plan your future treatment and future needs. That might include care, physiotherapy, speech and language therapy, transport, accommodation, psychological therapies, aids and appliances, education and work-related issues.
All the time that we are gathering the evidence, we are also ensuring that you have the very best possible therapies that you need to help you rebuild your life. We will secure interim payments to pay for the treatment and rehabilitation and, of course, to make up for any loss of earnings that you may have suffered.
We will support you and your family to take away as much stress and pressure as we can, and we will be there for you whenever you need us.
If we have to go to trial, we will arrange the very best representation for your case. We have access to the best of the best barristers throughout the country. We will give you the best possible expert advice at all stages in the personal injury claim process, so you can always rely upon us to tell you what the right settlement should be and when it is the right time to settle.
Our help and support don’t always end after settlement. Often we can be involved as professional deputies in appropriate cases where we assist you and your family with the ongoing management of health and welfare or financial issues.

Yes, we can take over your claim from your existing solicitor without any financial implications for you. You just have to sign a form of authority and we do the rest. We are able to take over cases that have legal aid funding and we will offer you a no win no fee agreement so that you will not be worse off financially.
Mostly personal injury cases do not go to trial. Most settle before trial. However, we work on the basis that your case has to be prepared as if it will go to trial. That way we achieve the very best result for you in the shortest possible time. If it does go to trial we will support you and your family every step of the way.
In most cases, the time for commencing a claim with the court is three years from the date of the negligent act. In some cases, it is three years from the date when you first realise that you have suffered a serious injury due to the negligence of another party. In fatal cases, it is three years from the date of death.
It can take a number of years to gather the evidence that you and we need to achieve a final resolution of the claim. Sometimes we have to wait until a medical condition or symptoms resolve before exploring settlement. In claims involving children we may have to wait until the child reaches a certain age to be able to determine what their needs will be in the future. We can give you an idea of the likely timescale of your case at the start.
We will be able to offer you a no win no fee agreement, which means that if you lose you don’t pay anything at all. If you win you may have to pay a success fee although we will discuss whether or not you will be asked to pay a success fee at the start and before you enter into the agreement with us. That way you can decide!
In some cases we will advise you to take out after the event insurance and we will be able to advise on that before we get started. The insurance premium is reasonably priced and is only payable if you win and at the end of the case.
